These Terms of Service (“Terms”) govern your use of esteroswfl.com (the “Site”), operated by Estero SWFL (“we,” “us” or “our”). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

Use of the Site

The Site provides local information about Estero and Southwest Florida, real estate listing search, calculators and a local business directory for personal, non-commercial use. You agree not to misuse the Site, including by scraping or harvesting data or listings, interfering with its operation, attempting unauthorized access, submitting false information, or using it for any unlawful purpose.

Real estate listings (IDX)

Listing information is provided through Internet Data Exchange (IDX) and comes from multiple listing services. It is provided exclusively for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. Information is deemed reliable but is not guaranteed and should be independently verified. Listings may be held by brokerage firms other than ours, and properties may be subject to prior sale, change or withdrawal. Square footage, HOA fees, CDD assessments, taxes, schools and other details are estimates; confirm them with the listing agent, association, district or other official source before relying on them.

Real estate services

Real estate brokerage services are provided by Sal DiBenedetto, Licensed Real Estate Broker, Dibe Real Estate, brokered by eXp Realty. Using the Site or contacting us does not by itself create an agency or brokerage relationship; any such relationship requires a separate written agreement. We are committed to compliance with federal and state fair housing laws and support equal housing opportunity.

Calculators, guides and market data

Mortgage, investment, Airbnb and seller net sheet calculators, market statistics, community guides and other content are for general informational purposes only and are not financial, legal, tax, insurance or professional advice. Results are estimates based on the information entered and general assumptions. Consult qualified professionals before making decisions.

Business directory

Business listings are provided for convenience. Unless expressly stated, we do not endorse, verify or guarantee any business, its licensing, insurance, work or pricing, and “accredited” or similar labels reflect only our own program criteria. Please verify licenses (for example, through the Florida Department of Business and Professional Regulation) and do your own due diligence. Businesses that submit listings are responsible for the accuracy of their information and grant us permission to display it.

User submissions

If you submit content — such as a business listing, review, comment or message — you confirm that you have the right to share it and that it is accurate and lawful, and you grant us a non-exclusive, royalty-free license to use, display and edit it in connection with the Site. We may remove any submission at our discretion.

Intellectual property

The Site’s design, text, graphics, logos and original content are owned by or licensed to us and protected by law. You may not copy, reproduce or distribute them without our written permission, except for personal, non-commercial viewing.

Third-party links

The Site links to third-party websites, including HOA, CDD, government and business sites. We do not control and are not responsible for their content, accuracy or practices.

Disclaimer of warranties

The Site and all content are provided “as is” and “as available” without warranties of any kind, express or implied, including accuracy, completeness, availability, merchantability or fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, we and our owners, agents and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or opportunities, arising from or related to your use of the Site or reliance on its content.

Indemnification

You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your submissions or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Lee County, Florida.

Changes to these Terms

We may update these Terms from time to time. The effective date above shows when they were last revised, and continued use of the Site means you accept the updated Terms.
